GoAtlas | Terms of Service

These Terms of Service (the "Terms") are effective from 25 October 2025.

GoAtlas is owned and operated by "Deep Solutions" ("Deep Solutions" жауапкершілігі шектеулі серіктестігі), a limited liability partnership registered in Kazakhstan (referred to collectively as "GoAtlas", "we", "us", or "our").

These Terms apply to your access and use of the GoAtlas mobile application, website (currently available at www.goatlas.app), and any related products, services, software, features or content (collectively, the "Services").

The Services include the provision of virtual walking and running challenges, digital progress tracking, route-based storytelling, and other gamified fitness experiences.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you and GoAtlas governing your access to and use of the Services. By accessing, installing, or using any part of the Services, you agree to comply with and be bound by these Terms.

If you are accessing the Services on behalf of an organization, group, or team:

(a)you represent that you are an authorized representative of that entity;

(b)all users within the organization must comply with these Terms; and

(c)the organization is responsible for any content or activity performed by its members through the Services.

You must not access or use the Services if you do not agree to these Terms.

You may not use the Services in any way that violates these Terms or any applicable law or regulation. You may not assist or encourage others in violating these Terms.

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if we reasonably believe you have breached these Terms or pose a risk to GoAtlas or other users.

2. Accounts and Account Security

To access certain features of the Services, you must create a user account by providing accurate and up-to-date information, including a valid email address. You agree to keep your account information current at all times.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you. You must not share your account credentials with anyone else.

If you believe that your account has been compromised or accessed without your permission, you must notify us immediately at [support@goatlas.app] or through in-app/in-website support.

GoAtlas is not liable for any loss or damage arising from your failure to safeguard your account or to notify us of unauthorized access. We reserve the right to suspend or delete accounts that violate these Terms or appear to be fraudulent, inactive, or otherwise harmful to the integrity of the Services.

3. Eligibility and Use by Minors

You may use the Services only if you are at least 13 years of age (or older if required by your local laws) and capable of forming a binding contract with GoAtlas.

If you are under the age of 16, you may only use the Services with the consent and supervision of a parent or legal guardian. By registering an account, you represent and warrant that you meet these requirements.

Parents or legal guardians who permit their child to use the Services are fully responsible for the child's use and any associated activity, including all content submitted and interactions with the platform.

GoAtlas reserves the right to apply additional restrictions, content filters, or limitations to accounts belonging to users under the age of 16.

We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If we learn that we have unintentionally collected such information, we will take appropriate steps to delete it.

4. Subscriptions, Billing, and Cancellation

Certain features of the Services may require a paid subscription ("Premium") or one-time purchases. If you choose to subscribe, you authorize us to charge your payment method for the applicable subscription fees and any applicable taxes on a recurring basis until you cancel.

4.1 Free Trials

If you receive access to a free trial, you will be automatically charged at the end of the trial period unless you cancel before the trial ends. Only one trial per user is allowed unless otherwise stated.

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel through your account settings or via the platform (e.g., App Store or Google Play) before the renewal date. Subscription fees are billed in advance and are non-refundable.

4.3 Cancellations

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will continue to have access to Premium features until then. No refunds or credits will be provided for partial periods or unused time.

4.4 Changes to Pricing

We reserve the right to change subscription pricing at any time. If we do, we will notify you in advance, and the new pricing will take effect upon your next billing cycle.

4.5 Payment Processing

All payments are processed by third-party providers (such as Apple, Google, Stripe, etc.). GoAtlas does not store or process your payment information directly.

You are responsible for ensuring that your payment information is valid and up-to-date. Failure to process payment may result in suspension or cancellation of your access to Premium features.

5. Acceptable Use of Services

You may use the Services only for personal, non-commercial, lawful purposes, and in accordance with these Terms.

You agree not to, and will not assist, encourage, or enable others to:

(a)access, use, or attempt to access the Services in any way not expressly permitted by GoAtlas;

(b)violate any applicable laws or regulations, including but not limited to privacy, intellectual property, and health data laws;

(c)use the Services in a way that could damage, disable, overburden, or impair any server, network, or database related to GoAtlas;

(d)upload or transmit any viruses, malware, or other harmful code or files;

(e)attempt to gain unauthorized access to any part of the Services, accounts, or systems;

(f)harvest or collect data about other users without their consent;

(g)use automated scripts, bots, or scraping tools to interact with the Services;

(h)impersonate any person or entity, or misrepresent your identity or affiliation with any person or organization;

(i)reverse-engineer, decompile, or attempt to discover the source code or algorithms of any part of the Services;

(j)use the Services for commercial purposes without prior written permission from GoAtlas;

(k)upload, post, or share any content that is offensive, harassing, abusive, discriminatory, obscene, or otherwise inappropriate.

We reserve the right to monitor use of the Services and to suspend or terminate access to any user who violates these rules, with or without notice.

6. Health Disclaimer and No Medical Advice

The Services offered by GoAtlas are intended for general fitness motivation, tracking, and entertainment purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge and agree that participating in any walking, running, or physical activity involves inherent risks, including risk of injury or health complications. You are solely responsible for assessing your own physical condition and determining whether it is safe for you to engage in such activities.

Before beginning any fitness challenge or training plan offered through the Services, you should consult with a physician or other qualified healthcare provider, especially if you have a medical condition, injury, or are pregnant.

GoAtlas does not guarantee any specific results from using the Services. We are not liable for any injuries, health issues, or damages (including damage to property) that may occur in connection with your use of the Services.

Any information or recommendations provided through the Services are for informational purposes only and should not be interpreted as medical or health advice.

7. Intellectual Property and Ownership

All content, features, and functionality available through the Services-including but not limited to text, images, graphics, illustrations, routes, maps, badges, progress systems, logos, trademarks, audio, video, software, and user interface design (collectively, "GoAtlas Content")-are owned by or licensed to GoAtlas and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use, strictly in accordance with these Terms.

You may not:

(a)copy, reproduce, modify, publish, distribute, display, sell, or transmit any part of the GoAtlas Content;

(b)remove or alter any copyright, trademark, or other proprietary notices;

(c)use the GoAtlas name, logo, or any branding elements without our prior written permission;

(d)create derivative works based on the GoAtlas Content or Services.

Any feedback, suggestions, or ideas you provide to us about the Services ("Feedback") may be used by GoAtlas in any manner, without restriction or compensation to you. We are not obligated to keep such Feedback confidential or to implement any suggestions.

All rights not expressly granted to you under these Terms are reserved by GoAtlas.

8. User-Generated Content (UGC)

The Services may allow you to upload, submit, post, or share content, including but not limited to photos, profile information, text, messages, route titles, or activity descriptions ("User Content").

You retain all ownership rights to your User Content. However, by submitting User Content through the Services, you grant GoAtlas a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display such content in connection with operating and improving the Services.

You are solely responsible for your User Content and represent and warrant that:

(a)you have all necessary rights and permissions to share it;

(b)your content does not infringe the rights of others or violate any law;

(c)your content is not defamatory, hateful, abusive, obscene, or otherwise inappropriate.

You may choose to set your User Content as public or private (where such settings are available). GoAtlas will make reasonable efforts to respect your privacy preferences but does not guarantee that content marked as private will never be accessed by others.

We reserve the right, but are not obligated, to monitor, remove, or restrict any User Content that we determine violates these Terms, applicable laws, or is otherwise harmful to the community.

You understand and agree that we may create, use, and share aggregated or anonymized data derived from User Content, provided such data does not identify you personally.

9. Privacy and Data Use

Your privacy is important to us. Please refer to our Privacy Policy, available at [https://goatlas.app/privacy], which explains how we collect, use, store, and protect your personal information when you use the Services.

By using the Services, you acknowledge and agree that GoAtlas may collect and process personal data as described in the Privacy Policy, including but not limited to:

•account registration information;

•activity data (steps, distance, time);

•device and usage information;

•geolocation data (where applicable and permitted);

•content you share through the Services.

You also agree that GoAtlas may use anonymized or aggregated data, which does not identify you personally, for analytics, performance optimization, and product improvement.

If you are located in the European Union, United Kingdom, or other jurisdiction with specific data rights, you may have additional rights under applicable privacy laws (such as GDPR). Please refer to the Privacy Policy for details on your rights and how to exercise them.

10. Third-Party Services and Integrations

The Services may contain links to or integrate with third-party platforms, software, APIs, content, or services that are not owned or controlled by GoAtlas ("Third-Party Services"), including but not limited to fitness trackers, mapping providers, health data platforms, and payment processors.

We provide access to these Third-Party Services as a convenience only. We are not responsible for their content, functionality, accuracy, availability, or any damage or loss caused by your use of or reliance on them.

You acknowledge and agree that:

(a)any use of Third-Party Services is governed solely by the terms and conditions and privacy policies of those third parties;

(b)GoAtlas is not a party to your relationship with those third parties;

(c)we make no warranties regarding Third-Party Services, and we do not guarantee that they will work correctly with the Services.

If you choose to connect your GoAtlas account to a Third-Party Service (such as syncing activity data from another app), you authorize us to access and use your data from that service as permitted by your settings and the third-party provider.

You assume all risks arising from your use of any Third-Party Services.

11. Modifications to the Services

GoAtlas is constantly evolving, and we may modify, update, or discontinue any part of the Services at any time, with or without notice.

This may include changes to features, content, routes, challenges, functionality, pricing, subscription plans, or availability of certain services. We may also push updates, patches, or upgrades to improve performance, fix bugs, or introduce new capabilities.

You understand and agree that:

(a)we are not obligated to maintain any specific feature or functionality;

(b)access to certain features may require an app update or an active subscription;

(c)some features may be offered on a limited or temporary basis;

(d)we may suspend or terminate parts of the Services for maintenance, technical reasons, or business decisions.

GoAtlas is not liable to you or any third party for any modification, suspension, or discontinuation of any part of the Services, provided such actions are taken in good faith and in accordance with these Terms.

12. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

GoAtlas does not guarantee that:

(a)the Services will be uninterrupted, secure, or error-free;

(b)any data, routes, or results provided will be accurate or reliable;

(c)the Services will meet your expectations or produce specific outcomes;

(d)any bugs or errors will be corrected.

You expressly agree that your use of the Services is at your sole risk. You assume full responsibility for any risk of loss, injury, or damage arising from your use of the Services.

To the maximum extent permitted by law, GoAtlas and its affiliates, officers, employees, partners, and licensors shall not be liable for:

•any indirect, incidental, special, punitive, or consequential damages;

•any loss of profits, data, goodwill, or other intangible losses;

•any physical injury, property damage, or health consequences related to the use of the Services.

In no event shall GoAtlas's total liability exceed the greater of:

(a)the amount you paid (if any) for the Services in the 12 months prior to the claim;

(b)one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless GoAtlas, its affiliates, officers, directors, employees, licensors, and partners from and against any claims, demands, disputes, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

(a)your access to or use of the Services;

(b)your violation of these Terms or any applicable law or regulation;

(c)your User Content, including any claim that it infringes, misappropriates, or violates the rights of any third party;

(d)your conduct, negligence, or misconduct while using the Services.

GoAtlas reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims.

This indemnity obligation will survive the termination of these Terms and your use of the Services.

14. Termination

You may delete your GoAtlas account at any time through the in-app settings or by contacting our support team at [support@goatlas.app].

We may suspend or terminate your access to the Services, or deactivate your account, at any time and without notice if:

(a)you violate these Terms or applicable laws;

(b)your account is inactive for an extended period;

(c)your behavior is harmful to the community or to the operation of the Services;

(d)required by law, court order, or governmental authority.

Upon termination, all rights granted to you under these Terms will immediately cease. You will no longer have access to your account or any content associated with it.

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Terms.

We are not liable for any loss of data, progress, or content following termination of your account, whether initiated by you or us.

15. Dispute Resolution and Governing Law

These Terms and any dispute arising from or relating to your use of the Services shall be governed by and interpreted in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of laws rules.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Almaty, Kazakhstan, and you hereby submit to the personal jurisdiction of such courts.

Before initiating formal legal proceedings, both you and GoAtlas agree to attempt to resolve any dispute informally and in good faith. If no resolution is reached within 30 days, either party may initiate formal legal action as permitted.

You agree to resolve any dispute on an individual basis and waive your right to participate in any class action, consolidated, or representative proceeding.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

16. Changes to Terms

We may update or modify these Terms from time to time at our sole discretion. If we make material changes, we will notify you by posting the updated Terms within the Services, on our website, or by sending an email or in-app notification.

Your continued use of the Services after any changes to the Terms indicates your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Services and may delete your account at any time.

It is your responsibility to review these Terms periodically to stay informed of any updates. The "Effective Date" at the top of this document indicates when the latest changes were made.

17. General Terms

17.1 Entire Agreement

These Terms constitute the entire agreement between you and GoAtlas regarding your use of the Services and supersede any prior agreements, representations, or understandings, whether oral or written.

17.2 No Waiver

Our failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of GoAtlas.

17.3 Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms without restriction.

17.5 Force Majeure

GoAtlas shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, or internet service interruptions.

17.6 Communication

Any notices or other communications under these Terms will be provided:

(a)via email to the address you provided, or

(b)through in-app notifications or updates.

17.7 Interpretation

Headings used in these Terms are for convenience only and shall not affect their interpretation. The words "including" and "such as" mean "including but not limited to."

17.8 Language

These Terms are written in English. If we provide a translation for convenience, the English version will control in case of any conflict.
